1. Introduction
These Terms of Sale govern all purchases made through 313 Gallery (the “Website”). By placing an order for any product made available through the Website, including limited releases and curated archive pieces (the “Products”), you acknowledge and accept these Terms of Sale in their entirety.
These Terms should be read in conjunction with any additional notices or conditions displayed in relation to specific Products or collections.

The Website is operated by 313 Gallery (“313 Gallery”, “we”, “our”, or “us”).
Further information regarding our Products, collections, and services is available throughout the Website. Following completion of your order, a confirmation of the essential details relating to your purchase will be provided electronically.
3. Order Acceptance
All orders placed through the Website remain subject to acceptance and availability.
An order shall only be considered accepted once you receive written confirmation from us via email. Until such confirmation is issued, no binding agreement shall exist between you and 313 Gallery.
We reserve the right, at our sole discretion, to decline or cancel any order prior to shipment.
4. Pricing
All prices displayed on the Website are determined exclusively by 313 Gallery and may be amended at any time without prior notice.
The applicable price for a Product shall be the price displayed at the time your order is submitted through the checkout process.
5. Product Availability & Order Refusal
Occasionally, a Product may become unavailable after an order has been placed. We further reserve the right to refuse or cancel orders where:
a Product has been incorrectly priced or described;
payment authorisation cannot be obtained;
delivery restrictions apply;
fraudulent or unauthorised activity is suspected; or
the order breaches these Terms of Sale.
Should a cancellation occur after payment has been received, all sums paid will be refunded to the original payment method.
6. Payment
Payment is collected in full at the time an order is placed.
Ownership of the Products transfers to you once payment has been successfully processed and received in full.
7. Taxes & Duties
For orders delivered outside the United Kingdom, import duties, customs charges, taxes, and local administrative fees may apply once the shipment reaches its destination country.
Such charges remain the sole responsibility of the recipient. 313 Gallery has no authority over these charges and cannot predict their amount, as customs policies vary between jurisdictions.
By placing an international order, you acknowledge that you are acting as the importer of record and are responsible for complying with all applicable local laws and regulations.
8. Delivery & Delays
Estimated delivery windows are provided for guidance only and are not guaranteed.
While we endeavour to dispatch all orders promptly, delays may occasionally arise due to circumstances beyond our reasonable control, including but not limited to customs processing, transportation disruption, severe weather, supply limitations, industrial action, or force majeure events.
313 Gallery shall not be held liable for delays caused by such events.
9. Product Presentation
We make every effort to ensure that all imagery, colours, and descriptions displayed on the Website accurately represent the Products.
However, due to variations in digital displays, lighting, archival condition, and photography, Products may differ slightly from how they appear online. Minor signs of age or wear may naturally exist on vintage or archive garments and should be considered part of their character.
10. Right to Cancel
Where applicable under consumer protection legislation, you may request to cancel your order within 14 days of receiving the Product.

Certain items are exempt from cancellation rights, including:
personalised or made-to-order items;
sealed goods opened after delivery where hygiene protection applies;
products altered at the customer’s request; and
items inseparably combined with other goods after delivery.
11. Returns
Returned Products must be shipped back within 14 days of your cancellation request.
Unless otherwise stated, return shipping costs remain the responsibility of the customer. We strongly recommend using a tracked and insured delivery service, as 313 Gallery cannot accept responsibility for returns lost in transit.
For international returns, a processing fee may be deducted from the final refunded amount.
12. Condition of Returned Items
All returned Products must be received in their original condition, including original packaging, tags, accessories, and accompanying materials.
Products showing signs of wear, damage, alteration, laundering, fragrance, or excessive handling may be refused or subject to a reduced refund reflecting diminished value.
Archive and collectible garments must be returned in the exact condition in which they were received.
13. Refused Deliveries
If a shipment is refused by the recipient and returned to us, any associated return shipping fees, customs charges, or administrative costs incurred will be deducted from the applicable refund.
14. Refunds
Approved refunds will be issued to the original payment method and in the original transaction currency.
Refunds are typically processed within 14 days of receipt and inspection of the returned Product, or upon proof of return shipment where applicable.
Original expedited shipping charges are non-refundable.

If you believe a Product received is incorrect, damaged, or materially not as described, please contact:

16. Product Modifications & Withdrawal
We reserve the right to modify, suspend, or discontinue any Product, collection, or release at any time without prior notice.
Where appropriate, customers affected by a withdrawal prior to dispatch will receive a refund of all amounts paid.
17. Personal Use
Products purchased from 313 Gallery are intended solely for personal use.
Commercial resale, redistribution, wholesale activity, or unauthorised marketplace listing of our Products without prior written consent is strictly prohibited.
We reserve the right to limit, refuse, or cancel orders suspected of being placed for commercial resale purposes.
18. Limitation of Liability
To the fullest extent permitted by law, 313 Gallery shall not be liable for indirect, incidental, or consequential losses arising from the purchase, use, delay, or inability to use any Product or service.
Nothing within these Terms excludes liability where such exclusion would be unlawful.

If any provision of these Terms is found unenforceable, the remaining provisions shall remain fully valid and enforceable.
Any delay or failure by us to exercise a right under these Terms shall not constitute a waiver of that right.
